Justice Mosley on January 23, 2024 made a ruling that the Emergency Act was illegally invoked to shut down the peaceful truckers protest Feb 14, 2022.
In this decision of the federal court Mosley ruled that the invocation of the Emergencies Act on February 14, 2022, by Prime Minister Justin Trudeau was "unjustified and unreasonable"...
1. The required conditions for proclaiming a Public Order Emergency stated in section 3 of the Act did not exist;
2. The procedure for invoking the Act as stated in sections 17 and 25 of the Act was not followed;
3. Using the Act to quell a peaceful and legal protest against the government's covid mandates, was illegal;
The invocation of the EA was deemed:
- unconstitutional therefore ultra virus
- unreasonable
- unjustified
Prime Minister Justin Trudeau acted outside of his legal authority by invoking the Act and therefore has no legal protection against prosecution for damages caused by applying the Act,
- R. v. Eldorado Nuclear Ltd.; R. v. Uranium Canada Ltd, 1983, Supreme Court of Canada
- The English Bill of Rights, Dispensing of Power, disallows a politician to use regal authority
Chrystia Freeland has stated that the decision will be appealed, therefore we, the citizens, and residents of Canada, ask parliament to withhold any public moneys for the appeal by Justin Trudeau, Chrystia Freeland, and others.
Now before the statute of limitations runs out Feb 14, 2024 all those hurt by these illegal actions need to sue.
Those who can sue are those who were prevented from protesting and could therefore no longer exercise freedom of speech and assembly. Also those who were assaulted, had property damaged or confiscated, bank accounts frozen and those arrested and released or arrested and charged.
